The 2-year Manufacturer Warranty
Legal Guarantees apply independently of the Manufacturer's warranty.
This 2-year Manufacturer Warranty is a commercial warranty provided by the manufacturer. It confers rights different from those the consumer may have under the law, including but not limited to those related to non-conforming products or products with hidden defects. The benefits provided by this 2-year Manufacturer Warranty are additional to the rights provided by law and do not replace them.
What the Manufacturer Warranty covers
From the date of purchase by the end-user, the manufacturer guarantees for a period of 2 years the products it manufactured, sold in their original packaging, against any material and manufacturing defects if used in accordance with the instructions for use and other technical characteristics.
What the Manufacturer Warranty does not cover
This Manufacturer Warranty does not cover hardware and software other than the ones manufactured by the Manufacturer, even if sold or packaged with the Product.
Also, the Manufacturer Warranty does not apply to:
- a) Beyond 1 year (thus a limited warranty of 12 months), for consumable parts such as batteries, sensors, or protective coatings intended to wear out over time.
- b) Aesthetic damage, including but not limited to scratches, scrapes, or breaks in plastic components.
- c) Damage caused by use with a component or product from a third party that does not meet the specifications of the Product (example: battery charger).
- d) Damage caused by accident, misuse, improper use (example: water ingress due to improper tightening of sensors or closing the lid).
- e) Damage caused by product use not in accordance with directives published by the Manufacturer, whether it be the user guide, technical specifications, or other directives (example: improper product storage conditions or failure to follow sensor calibration and maintenance instructions).
- f) Damage caused by any intervention or modification performed by anyone other than the Manufacturer representative or an authorized service center (example: removing closure and sealing screws from the product).
- g) Damage resulting from normal wear and tear or normal aging of the Product.
- h) If information indicates that the product has been stolen or the user cannot prove they are the authorized user of the product (e.g., by presenting proof of purchase).
Important Restrictions
The Manufacturer may restrict warranty service to countries where itself or its authorized resellers sell the device.
The consumer may request repair in a country other than the country of purchase. In this case, they will be required to comply with all applicable import and export laws and regulations, and they will be responsible for customs duties, VAT, and other related taxes and fees.
After warranty service is provided, your product or a replacement product will be returned with the original configuration at the time of purchase, subject to applicable updates. Retrieval and reinstallation of software, data, and other information are not covered under this warranty.
The Manufacturer may install system software updates as part of the warranty service that will prevent the Product from reverting to a previous version of the system software. Third-party applications that have been linked with the Product may not be compatible or may not function due to the system software update. Restoration of services and data related to these third-party applications is not covered under this warranty.
Implementation of the 2-year Manufacturer Warranty
For products purchased directly from the Manufacturer or from one of its authorized resellers, the procedure for any request to implement the 2-year Manufacturer Warranty is as follows:
- Contact the manufacturer Customer Service using one of the means provided on the Help page of the application or contact the authorized reseller where the Product was bought.
- Provide proof of purchase of the product through a receipt or invoice, explicitly mentioning the date and store of purchase.
- c) Provide the product serial number (SN or UUID).
- d) A unique dossier number will be assigned to identify the buyer and the product concerned by the request.
- The Customer Service will assist the buyer. If the problem cannot be resolved remotely and/or if technical diagnosis is necessary to determine if the defect falls within the scope of the Manufacturer Warranty coverage, the buyer may be referred to a Service Center authorized by the Manufacturer.
- f) The consumer may be asked to answer questions in order to allow diagnosis of potential problems, as well as to follow procedures to obtain warranty implementation.
Limitation of Liability
- a) Entire Agreement: Except for rights granted by consumer protection law, as specified at the beginning of this document, all warranties and other conditions not stipulated in this warranty document are, to the extent permitted by law, excluded from the 2-year Manufacturer Warranty.
- b) Data Disclaimer: the Manufacturer does not warrant, represent, or promise to be able to repair or replace a Product under this warranty without risk and/or loss of information and/or data stored on the Product.
- c) Limitation of Liability: In no event shall the Manufacturer be liable for damages to property, persons, profits, or business arising from the use of its products. More generally, the Manufacturer shall not be liable for any damage, loss, expense, fee, or purely economic cost, special, indirect, consequential, or purely economic.
General Provisions
No reseller, employee, or agent of the Manufacturer is authorized to make any modifications, extensions, or additions to this warranty.
If any condition is deemed illegal or unenforceable by law, it shall be excluded from the warranty, and the legality or enforceability of the other conditions shall not be affected.
This Warranty is governed and construed in accordance with the laws of the country in which the Product was purchased.
